Navigating Legalized Marijuana: An Overview for Employers MARIJUANA IS ILLEGAL UNDER FEDERAL LAW. However, due to cultural earthquakes and a flurry of legislation in recent years, many states have legalized it for medicinal use, recreation, or both. Yet even in states where it is legal, the law can compel certain types of employers to take action to ensure that their workplaces are drug-free. As if those conflicts were not sufficiently incongruent, discrepant signals from within the same jurisdiction can send workplace managers reeling. For example, the current administration reversed an Obama-era policy that the federal government would refrain from interfering with state pot policies. Yet President Trump has also said that he supports states’ rights on the issue. For employers, it’s all a purple haze.
