How to Handle Remote Work as an Accommodation Under the ADA and PWFA

Content Summary

Remote work is now the most requested
accommodation under the ADA and the
PWFA. In our 2025 State of Leave and
Accommodations report, more than half of HR
leaders said it topped their list last year.
These requests often sound simple, but they
rarely are. What worked during COVID may not
fit today’s business needs. Return-to-work
policies are directly impacting employee
behavior, and many are turning to ADA to keep
the flexibility that worked best for them.
Employees are requesting remote work even
when being in person is an essential function
of their job, putting HR in a bind.
