Content Summary

Despite the growing reliance on AI, there is currently no unified federal law governing how these technologies can or should be used in employment settings. Additionally, statutes that prohibit discrimination, govern background screening, and protect health information can all be triggered by the deployment of AI.

As the use of AI continues to grow, several States have begun introducing their own legislation. In addition to understanding which State-specific AI laws they might be impacted by, employers must evaluate their use of AI systems through the lens of long-standing workplace laws. Overlooking these obligations could expose employers to significant compliance risk, even when the underlying technology appears to be neutral or beneficial.

To assist employers with better understanding the various State and Federal laws surrounding or impacted by the use of AI, HR Works has developed a comparison chart, summarizing existing laws and outlining key AI-related considerations for Federal laws.
