- Recruitment Phase: Employers must test the labor market by advertising the position. This step usually takes two to three months, followed by a one-month cool-off period to review responses and conduct interviews before moving forward.
- PERM Processing: After completing the recruitment, the employer must file FORM ETA 9089. Once submitted, the DOL may take eight to twelve months to process the application. These perm processing times vary each fiscal year, and the DOL releases data showing trends in average processing time for employers and applicants.
- Audits: If the DOL selects the application for an audit, the processing time may extend by six months to a year. The DOL may ask employers to respond with more data or evidence about recruitment efforts, job duties, and wage levels.
The process can take 15 to 24 months from start to finish, and in some cases, longer if complications arise. Monitoring perm processing times is especially important for employers who want to plan hiring around a specific date or fiscal cycle.
