Critical Compliance Update: Changes to Affirmative Action Requirements

On January 21, 2025, the White House issued the Executive Order  “ Ending Illegal Discrimination and Restoring Merit-Based Opportunity ,”  revoking Executive Order 11246. This directive introduces significant changes for federal contractors and subcontractors, including a 90-day transition period to align with the regulatory framework in effect as of January 20, 2025.

 

Key Updates for Federal Contractors

 

The Office of Federal Contract Compliance Programs (OFCCP) will:

  • Cease promoting “diversity” initiatives.

  • Discontinue affirmative action obligations for federal contractors and subcontractors.

  • Prohibit workforce balancing based on race, color, sex, sexual preference, religion, or national origin.

 

What Remains Unchanged

 

The statutory requirements under:

  • Section 503 of the Rehabilitation Act  (supporting individuals with disabilities).

  • Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA)  (protecting covered veterans).

 

These obligations are still enforced by the OFCCP.
