States including Alabama, Arizona, Florida, Georgia, Mississippi, North Carolina, South Carolina, Tennessee, and Utah require E-Verify for some or all private employers, often above an employee-count threshold. Indiana now penalizes knowingly employing unauthorized workers and treats E-Verify as a safe harbor, and Ohio requires it for nonresidential construction. Federal contractors with the FAR clause must enroll within 30 days of award, start verifying new hires within 90 days of enrolling, and verify existing employees assigned to the contract within 90 days of enrolling or 30 days of assignment, whichever is later.
